as a general waiver or relinquishment of any other provision
of this Agreement.
The parties’ obligations
under this Terms Of Service Agreement are subject to, and
neither party shall be liable for, delays, failures to
perform, damages, losses or destruction, or malfunction of
any equipment or any consequence thereof caused or
occasioned by, or due to fire, flood, water, the elements,
labor disputes or shortages, utility curtailments, power
failures, explosions, civil disturbances, governmental
actions, shortages of equipment for supplies, unavailability
of transportation, acts or omissions of third parties, or
any other cause beyond the party’s reasonable control.
In no event shall WebHostsOnline.com be liable to user or
any of user's customers or any other person, firm or entity
in any other respect, for direct, indirect, consequential,
special, incidental, actual or punitive damages, or for any
lost profits of any kind or nature whatsoever, even if
foreseeable, arising out of any mistake, accident, error,
omission, interruption, or defect in transmission, or delay
arising out of or relating to the services or the
obligations of WebHostsOnline.com pursuant to this agreement
and any exhibits or schedules hereto including, without
limitation, (i) any failure to provide timely or accurately
provision any WebHostsOnline.com service, or (ii) adverse
conditions which may result from actions by regulatory or
judicial authorities.
WebHostsOnline.com's entire
liability for any claim or loss, damage or expense from any
cause whatsoever, except for those arising from or in
connection with WebHostsOnline.com's gross negligence, shall
in no event exceed the monies actually paid to WebHostsOnline.com
under this agreement by the party claiming fault. No action
or proceeding against WebHostsOnline.com may be commenced
more than one year after the services are rendered.
This site and its content is
protected by copyright as a collective work and/or
compilation, pursuant to Canadian copyright laws,
international conventions, and other copyright laws. Any
reproduction, modification, publication, transmission,
transfer, sale, distribution, performance, display or
exploitation of any of the content from this site, whether
in whole or in part, without the express written permission
of WebHostsOnline.com is strictly prohibited.
Any disputes that may arise
under this Terms Of Service Agreement shall be resolved in
accordance with the laws of the Province of Ontario. Each
party agrees that jurisdiction and venue for any and all
disputes under this Terms Of Service Agreement will be
proper in the Cumberland District of the Province of
Ontario, Canada, and that the establishment of such
jurisdiction and venue shall be determined by WebHostsOnline.com.

Advertising Terms
WebHostsOnline.com
currently accepts Visa,
MasterCard, American Express, Discover credit cards as well
as PayPal, checks and money orders for the purchase of
advertisements. Our preferred method of payment is via
credit card or PayPal.
Purchase of advertising space
is subject to the following:
- All advertising must be
paid 100% prior to insertion.
- Check or money order
payments are subject to a minimum order of $250.00.
- Non-certified checks from
first-time customers will require an additional 10
business days to clear once we receive them.
- Any purchase under $250.00
must be made using a credit card or PayPal.
- All creative must be
received 48 hours prior to the date of insertion.
- Advertisers are provided
with access to campaign statistics that include real
time data on impressions, clickthroughs and unique
visitors.
- All payments for
WebHostsOnline.com are handled by NVSInc.net.
- Advertising rates are
subject to change at our discretion and will be based on
available inventory, site traffic and market trends.
- Always contact us prior to
making any purchase to review pricing and availability.
We reserve the right to edit
any creative submitted for advertising to suit
WebHostsOnline.com requirements. We reserve to right to
refuse any advertisement and make any change to our
